By participating in the Moody experience, you acknowledge that the use of the sauna, plunge pools, and related facilities comes with inherent risks. These risks include, but are not limited to, burns, dehydration, injury, or other physical harm resulting from exposure to extreme temperatures, water-related activities, or misuse of the facilities.
By signing this waiver, you agree to the following:
1. Assumption of Risk
You understand that participation in the services offered by Moody involves physical exertion, heat exposure, and cold immersion, and you freely and voluntarily assume all risks associated with these activities.
2. Health Considerations
You confirm that you are in good health, free of any medical conditions that may be aggravated by the sauna or cold plunge activities. If you have any medical conditions (e.g., cardiovascular issues, respiratory problems, pregnancy, etc.), you will consult with a healthcare provider before using the facilities.
3. Essential Oils
Moody may use essential oils during your sauna experience. If you have any known allergies or sensitivities to essential oils, you must inform the staff prior to your session to avoid exposure to allergens.
4. Age Restrictions
The sauna is only available to individuals 16 years and older. If you are under 18 years of age, you must be accompanied by an adult during your session.
5. Responsibility for Safety
You agree to follow all Moody rules, guidelines, and safety instructions provided by the staff, and to behave responsibly and respectfully towards the facilities, staff, and other customers at all times.
6. Booking for Others
If you are booking a session for others, you are responsible for ensuring that each individual is familiar with and agrees to the terms of this waiver.
7. Release of Liability
You release Moody, its owners, employees, contractors, agents, and affiliates from any and all liability, claims, demands, or causes of action that may arise from your use of the facilities, including those arising from negligence, breach of contract, or other legal theories. This includes any injury, loss, or damage that may occur to you or your property.
8. Indemnity
You agree to indemnify and hold harmless Moody from any claims, liabilities, damages, or expenses (including legal fees) that arise from your use of the facilities, including any actions of negligence on your part.
9. Right to Refuse Service
Moody reserves the right to refuse service to anyone who is disruptive, intoxicated, or does not comply with the rules and safety guidelines. Moody also reserves the right to expel individuals from the premises if their behavior is deemed inappropriate or unsafe. No refund will be given for refusal of entry or expulsion from the facility.
10. Photography and Media Release
You acknowledge that you may be photographed or filmed during your time at Moody and consent to the use of these images and videos for promotional, marketing, and social media purposes.
